Use of ChefsWorld.net

1.        ChefsWorld.net content, including the information, names, images, pictures, logos and icons regarding or relating to ChefsWorld.net / ltd, its products and services (or to third party product and services), is provided “as is” and on an “is available” basis without any representation or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
   
2.        Under no circumstances will ChefsWorld ltd be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of ChefsWorld.net regardless of the form of action.
   
   
3.        ChefsWorld ltd does not warranty that functions contained in ChefsWorld.net content will be uninterrupted or error free, that defects will be corrected, or that ChefsWorld.net or the server that make it available are free of viruses or bugs.

Intellectual Property
 

1. The names, images and logos identifying ChefsWorld ltd, ChefsWorld.net or third parties and their products and services are subject to copyright, design rights and trade marks of ChefsWorld ltd and/ or third parties. Nothing contained in these terms shall be construed as conferring by implication, estoppels or otherwise any licence or right to use any trademark, patent, design right or copyright of ChefsWorld ltd, or any third party.

Contributions to ChefsWorld.net
 

2. Where you are invited to submit any contributions to ChefsWorld.net (including any text, photographs, graphics, video or audio) you agree, by submitting your contributions, to grant ChefsWorld ltd a perpetual, royalty-free, non-exclusive, sub-licensable right and licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to your contribution worldwide and/ or to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution, and in accordance with privacy restrictions set out in ChefsWorld.net Privacy Policy. If you do not want to grant ChefsWorld the rights set out above, please do not submit your contribution to ChefsWorld.net.

3. Further to paragraph 2 (contributions), by submitting your contribution to ChefsWorld.net you:

Warrant that your :

3.1.1           Is your own original work and that you have the right to make it available to ChefsWorld.net for all the purposes specified above;

3.1.2           Is not defamatory; and

3.1.3           Does not infringe any law; and

 3.2    Indemnify ChefsWorld ltd against all legal fees, damages and other expenses that may be incurred by ChefsWorld ltd as a result of your breach of the above warranty; and

 

3.3    Waive any moral rights in your contribution for the purposes of its submission to the publication of ChefsWorld.net and the purposes specified above.

Membership Eligibility 

1.       Our services are not available to, and may not be used by, persons under the age of 18 years. If you are under 18 years old, you can use this service only in conjunction with and under the supervision of parent or guardian. Chefs of all qualification and experience may use the chef’s entrance but cannot use employer’s entrance and employers are not to use the chef’s entrance. If you do not qualify, please do not use our services. If you are registering as a business entity, you represent that you have the authority to bind that entity to this user agreement.

User ID 

1.       You must choose a user ID and password on completion of registration. You are responsible for all actions taken under that user ID and password and shall only utilise the site using your own user ID and password. You must use every effort to keep your password safe and should not disclose it to any other person. You shall not transfer or sell your user ID to any other person. You shall also not permit, either directly or indirectly, any other person to utilise your user ID or password. 

Liability

1.       In the event that you have any right, claim or action against any other user arising from that users use of the site, you agree to pursue such right, claim or action independently of and without recourse to us, and you release ChefsWorld ltd (and our subsidiaries, affiliates, officers, directors, agents and employees) from all claims, liability, damages, losses, costs and expenses, including legal fees, known or unknown, arising from or in any way connected with such right, claim or action.

Information Control 

1.       We do not control the information provided by other users, which is made available through the site. You may find other users information to be offensive, harmful, inaccurate, or deceptive. Please use caution, common sense and practise safe Internet use when using this site. By using this site, you agree to accept such risks and agree that ChefsWorld ltd is not responsible for the acts or omissions of users of the site.

Fraud

1.       Without limiting any other remedies, we may suspend or terminate your account if we suspect that you have engaged or are about to engage in, or have been any way involved in or linked to, fraudulent activity in connection with this site.

Fees

1.       Our fees are described in our fees policy, which forms part of this user agreement. Unless otherwise stated, all fees are payable in GB Pounds sterling. Whether you are a business or not, value added tax and other taxes may apply to your transaction. Employers will be responsible for paying all fees associated with using our service and our site and all applicable taxes. You agree that we may issue you with invoices in electronic format by email.

Restrictions

Your information and your activities on our site must not:

• Be false, inaccurate or misleading;
• Be offensive or menacing, abusive, defamatory, or in breach of copyright, confidence, privacy or any other rights;
• Infringe any third parties copyright, patent, trade mark, trade secret or other proprietary right or rights publicity or privacy;
• Be in breach of any applicable laws or regulations (including, but not limited to, laws governing consumer protection, unfair compition, anti-discrimination, false advertisement);
  ·         Be obscene, indecent or contain child pornography;
• Create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers;
• Contain any computer viruses, macro viruses, Trojan horses, worms or anything designed to interfere with, interrupt or disrupt normal operating procedures of a compute or to surreptitiously intercept, access without authority or expropriate any system, data or personal information;
• Cause the site to be interrupted, damaged, rendered less efficient or such that effectiveness or functionality of the site is in any way impaired.

Your use of other users information

1. In order to facilitate interaction among all ChefsWorld community members, our service allows you limited access to other users contact information. As a member you have access to the user ID, email address and other contact information of chefs.
2. By accepting this user agreement, you agree that, with respect to other users personally identifiable information that you obtained through the site. You may only use the information for: (a) ChefsWorld related communication that are not unsolicited commercial messages and related to your genuine participation in ChefsWorld communication, (b) using services offered through ChefsWorld, and (c) any other purpose that such user expressly agrees to after adequate disclosure of the purpose(s). In addition, you shall only use such information accordance with applicable laws and regulations, including without limitation data protection and privacy laws. In all cases, you must give users the opportunity to remove themselves from your database and a chance to review what information you have collected about them. In addition, under no circumstances, except as defined in this section, can you disclose personally identifiable information about another user to any third party without our consent and the consent of such other user after adequate disclosure. Note that law enforcement personnel, Osprey programme participants, and other rights holders are given different rights with respect to information they access.
3. ChefsWorld and our users do not tolerate spam or unsolicited commercial communications. Therefore, without limiting the foregoing, you shall not add a ChefsWorld employee or user, even a user who’s c.v you have searched or job add respondent, to your mail list (email or physical mail) without their express written consent after adequate disclosure.

Breach

 

1.       Without limiting our other remedies, we may limit your activity on the site, immediately issue a warning, suspend or terminate your user registration and refuse to provide our services to you without notice to you or the refund of any fees paid: (a) if you breach this user agreement or the documents incorporated; (b) if we believe that your actions may cause us financial loss or legal liability.

Transfer of data

1.   We view protection of users privacy as a very important community principle. Please note that your information will be stored and processed on our computers in Malta. The laws on holding personal data in Malta may be less stringent than Uk laws but ChefsWorld will hold and transmit your information in a safe, confidential and secure environment. If you object to your information being stored or transferred or used in this way please do not register.

Employers

Prices

1. Prices are guaranteed for the period stated on the order form (30 days).
2. All prices exclude VAT. Invoices are payable prior to access being granted to chosen service.

Employment agencies and employment businesses

1. If you are an employment agency or an employment business (as defined by the employment agencies act 1973) it is your responsibility to ensure that advertisement you place on ChefsWorld.net comply with your obligations under the act and conduct of employment agencies and employment business regulations 2004. You agree to comply with the act and these regulations as they affect the conduct of your business and the advertisements you place on ChefsWorld.net.

 

Advertisement rules 

1. No duplicating jobs at the expense of other clients jobs
2. No gratuitous use of keywords in job descriptions or job titles
3. Job advertisements must be for genuine vacancies only
4. Advertisements, which appear to discriminate on grounds of sex, race or disability, are illegal and may result in proceedings being taken against the advertiser. If we believe any advertisement may be discriminatory we may at our discretion either amend or remove the advertisement, without refund of fees paid.
5. You agree to deal fairly and professionally with individuals who may respond to an advertisement you have posted.
6. We do not guarantee any response to your advertisement or c.v search or that responses will be from individuals suitable for the job advertised. It is your responsibility to carry out such checks and procedures as necessary to ensure that candidates are suitable for the job advertised.
7. It is your responsibility to ensure that you have the appropriate equipment and are connected to the appropriate services to enable you to post jobs to ChefsWorld.net

Cancellation

Job Adverts	Job adverts are placed for 30 days. Should you wish to cancel an advert earlier than this you may do so using the “View My Adverts” link. Your fees for placing the advert will not be refunded.
Database Search	If you have subscribed to search the Chefs CVs database or the Relief Chefs database for a 30 day period and which to cancel your subscription you may do so by e-mailing tim@chefsworld.net. Your subscription will be cancelled within 7 working days. Your subscription fee will not be refunded.
Chefs Membership	Should you wish to cancel your membership please e-mail tim@chefsworld.net. Your membership will be cancelled within 7 working days.
Refund Policy	All subscriptions, advertising services and membership plans provided by ChefsWorld are non-refundable. If you feel a service you purchased or subscribed to on ChefsWorld was not as described, please e-mail tim@chefsworld.net. We will look into your complaint and contact you within 7 working days.
